Malpractice Double Standards

It is indeed interesting that lawyers sue accountants, doctors and other professionals for malpractice any time they make the mistake. Unfortunately, when it comes to suing lawyers, their double standards come to the fore. The most common argument in such cases is, the lawyer made an honest mistake. Sure, it may be, but why the double standards?

If you have been at the receiving end of bad legal practice, you would definitely have heard this argument. Lawyers on the American Bar Association's Internet Forums often consider themselves above such suspicion. They argue that a well-intentioned lawyer who made a mistake should not be punished. Well, this is the attitude that lets most lawyers go scot-free. Why should one person be sued for malpractice while the other walks away untouched, merely because he is a lawyer?

Of course, it is true that legal malpractice cases are difficult to win. This is because the law is such that the claimant has to prove all the elements of the case. But it is very difficult to even find a lawyer who is willing to take up the case. And even if you do find one, you have to shell out exorbitant amounts of money.

More often than not, the law is abused by lawyers. They use their profession as a cover against bad practices. Until these double standards are looked at, there can be no peace in any professional field. A thorough review of the legal system is needed, to ensure that every professional gets a fair deal.
